Sexual Violence Policy

1. Purpose
Canadian College of Business, Health and Arts Inc. (‘the College’) is committed to providing a safe and respectful learning and working environment for all students, staff, and visitors. This policy outlines the College’s commitment to preventing and addressing sexual violence in accordance with Ontario Regulation 415/06, Section 36.0.2.
2. Scope
This policy applies to:
– All current and prospective students
– All employees, faculty, contractors, and volunteers
– Any location related to College activity, including online platforms and social settings
3. Definition of Sexual Violence
Sexual violence includes any sexual act or act targeting a person’s sexuality, gender identity or gender expression without their consent. Examples include, but are not limited to:
– Sexual assault
– Sexual harassment
– Stalking
– Indecent exposure
– Voyeurism
– Distribution of sexually explicit images without consent
– Any attempt or threat to commit any such acts
4. Commitment to Survivors
– Survivors will be treated with dignity and respect.
– Their right to privacy will be protected and upheld.
– They will be informed of all available support and options, including academic and legal supports.
5. Reporting an Incident
Any student, employee, or third party who believes they have experienced sexual violence may report it to:
– The College’s Student Services Office
– The Designated Sexual Violence Officer via email: info@ccbha.ca
– Reports can be made in person, via email, or in writing.
– Anonymous disclosures are permitted but may limit the ability of the College to investigate.
6. Investigation Procedures
– All reports will be acknowledged within 2 business days.
– An impartial investigation will be initiated where appropriate.
– The respondent will be informed of the allegations and given an opportunity to respond.
– Investigations will be completed within 30 days, barring exceptional circumstances.
7. Interim Measures
While an investigation is ongoing, the College may impose interim measures to ensure safety, such as:
– Modifying academic schedules
– Campus access restrictions
– No-contact orders
8. Support Services
– Academic accommodations
– Mental health support and counselling referrals
– Information about external support agencies (e.g., Sexual Assault Centres, Legal Aid)

9. Confidentiality
All reports and investigations will be handled with strict confidentiality, in accordance with applicable laws and college policies. Personal information will only be shared when necessary to:
– Conduct a fair investigation
– Meet legal or safety obligations
10. Prohibition of Reprisals
No individual will face retaliation for reporting sexual violence in good faith. Disciplinary action may be taken against anyone who retaliates.
11. Training and Education
The College will offer mandatory awareness training to all new students and staff, and ongoing prevention education to the community.
12. Policy Review
This policy will be reviewed every three years or as required by law.
